The purpose of this privacy policy is to explain to users of the Terre de Haut SaaS solution (“hereinafter Terre de Haut”) and its Terre de Haut app application, in accordance with current legislation, the efforts made to protect users' personal data and guarantee the confidentiality of these as well as of the data for which we act as a subcontractor.
This page aims to provide information on the data collected by Terre de Haut and its application Terre de Haut app, the objectives pursued justifying the processing of these and the rights available to users.
Lexicon
" User " designates a natural or legal person having entered into a contract with Terre de Haut and/or using the Terre de Haut app.
“Customer” designates natural or legal persons entering into contracts with users of the Terre de Haut SaaS solution and whose certain data may be collected on the Terre de Haut app application for its proper execution.
1 - Data collected and objectives pursued
The data collected is intended to allow users to register and connect to the Terre de Haut solution and its Terre de Haut app application in a secure manner and to be able to use its functionalities. They can also be used by our teams to send information emails on new features or actions to be taken to ensure the continuity of the functionalities offered by the application (important updates for example) or even improve the user experience.
In this context, we collect and are directly responsible for the processing of the following data from our users:
Name
First name
Email address
Phone number
Products and services provided by the user
Turnover of goods and/or services managed through the application
Statistical data of goods and/or services managed through the application
Furthermore, as part of the functionalities of Terre de Haut and the Terre de Haut app application, and in order to ensure the proper execution of the contract between the user and their customers, we may be required to collect the following data for the latter as a subcontractor:
Name
First name
Email address
Phone number
Details of orders placed
Details of requested reservations
Messages sent
Data relating to the number of orders or reservations made

2 - Means of collecting your data
User data is collected either when they first register with Terre de Haut and/or the Terre de Haut app using the dedicated form, or during their exchanges with our sales teams.
The collection of data relating to the smooth running of our users' contracts with their customers, and for which we act as a subcontractor, is carried out at the time of the said contract between the user and his customers and is considered to be consented to by all parties within the framework of the general conditions of sale provided to his customers by the user.
No other data is collected by the application or by our teams without the explicit consent of the people concerned and it will only be used for the legitimate purposes defined with them.
3 - Retention period and user rights
To ensure the proper functioning of the Terre de Haut app application and allow users to log in to their account, we retain user data for the entire duration of use of the application.
Our employees and subcontractors may only have access to user data to the extent necessary to ensure the execution of the objectives pursued and defined in point 1.
Users have the right at any time to verify, access, rectify, delete, transfer and object to the use of their data by contacting us at contact@videomark.com
We will then do everything we can to satisfy your request.
4 - Cookies
We also collect cookies to ensure the security and good continuity of our services, including:
the date and time a user logged in
the IP address of the medium used to access the application
5 - Bonds and securities
The teams working for Terre de Haut undertake not to transmit the data collected directly as data controller or indirectly as a subcontractor to third parties without the user having been informed and to respect the purposes for which this data was collected. The application has an SSL certificate to ensure that the information and data transfer passing through the application are secure. In addition, the data controller undertakes to notify the user in the event of rectification or deletion of the data, unless this entails disproportionate formalities, costs and procedures for the user.
In the event that the integrity, confidentiality or security of the user's or its customers' data is compromised, the data controller undertakes to inform the user by any means.
6 - Data hosting
Our applications are hosted at Vicem (https://vicem.com/), 6 rue des Bateliers, 92110, Clichy, France. The Customer's data is stored on servers in France.
7 - Data sharing
Terre de Haut app does not share the data collected other than for the purpose of ensuring the proper functioning of the solution.
Data, such as the IP address and type of devices used by our users, is collected and shared encrypted and anonymously to our error reporting software (Sentry).
8 - Policy relating to data concerning minors
L'application Terre de Haut app is not intended for minors and does not collect personal data except that provided voluntarily by our users' customers. 9 - Acceptance and modification of this confidentiality policy
Using the SaaS solution Terre de Haut, the user certifies having read and understood this confidentiality policy and accepts its terms.
This confidentiality policy may be subject to change in order to guarantee its compliance with current law and the user is invited to consult it regularly.
10 - Right to refer the matter to the competent supervisory authority
In the event of a dispute over data processing, we encourage our users to contact our teams in order to find a satisfactory solution.
The user has the right to contact the CNIL (National Commission for Information Technology and Liberties, https://www.cnil.fr) or any competent judge.
